GOOD ASPECTS: They respect "Do Not Track" signals. They don't keep personal information after it is used for its intended purpose. They offer safe browsing opt-out; location awareness opt-out; google analytics opt-out browser add-on; all good.

BAD ASPECTS: They have a privacy policy and a privacy notice. Confusing. They don't provide an email address--just a snail mail address. They do not discuss account recovery and cell phone porting in a proper manner.


The Right to Equal, Fair, & Reasonable Expression 3 out of 5

BAD ASPECTS: They can kick you off the communities for any reason whatsoever, but it's mostly a browser, so not a huge issue.

GOOD ASPECTS: They do not specify any censorship rules, which is good.


The Right to Control My Intellectual Property 3 out of 5

GOOD ASPECTS: There's a good link to report IP infringement, but it's unclear about their process for ensuring that false accusations don't inadvertently remove content. You own your copyrights.

BAD ASPECTS: Allows a non-exclusive, royalty-free, and worldwide license that is sublicensable, but... the sublicense is only to those they work with, and not to random third parties, so that's good.

BAD ASPECTS: The required venue of Santa Clara County, CA is only mentioned in one of the many agreements, so that's not cool. Further, your recovery is limited to $500, and most any lawsuit will cost you more than that.

BAD ASPECTS: The cookie policy has too many 'learn more' links. Not cool. The legal page is a mess, with so many confusing policies.

Ways to improve

1. Consolidate all the policies into one. Your current situation is a big mess.
2. Put your contact email address far more prominently
3. Allow people to sue you from their home cities.
4. Don't put a cap on recovery of damages.
5. Allow arbitration if a user wishes.
6. Establish fair process and right to be heard.
7. Establish an appeals process and right to return.
8. Add your TOS rating and link to your TOS page as outlined in our guidelines. You currently are being given all 20 points.
